A ampla utilização da Internet para inúmeras atividades levou à criação de novos paradigmas no relacionamento humano e permitiu mudanças significativas no pensamento, na construção e veiculação do conhecimento científico assim como nas estruturas sociais estabelecidas ao longo do tempo. Para refletir sobre o acesso ao conhecimento e suas formas de veiculação atual, o artigo apresenta uma revisão de literatura sobre o tema com o objetivo de compreender os principais componentes e metodologias que vêm sendo desenvolvidos pela ciência aberta principalmente (...) como uma nova alternativa de participação social nos entornos digitais voltados à criação do conhecimento. Somos dominados pelas mesmas tecnologias que criamos, retroalimentando um aparato que funciona através de nós, que constitui o final da história como concebida por Marx: construída pela humanidade. Realizamos os projetos da modernidade, as potencialidades de nossa cultura ocidental nos provaram ser amedrontadoras. Nossa sociedade foi fabricada segundo regimes de registro, consumo e produção, de tal maneira que o processo nunca para. Quebrar (...) com essa lógica do aparato implica em projetar novas formas e forças que permitam que se projetem novos futuros. Assim, para além do método enquanto ferramenta de trabalho do Real, a deontologia de novos mundos livres de maquinações perversas, do império do método da sociedade pós-industrial, a fim de produzir uma nova história. O presente artigo pretende discutir e refletir sobre as contribuições da chamada Teoria Crítica da Sociedade para o campo da educação em tempos de crescente desenvolvimento tecnológico. Para tanto, voltamos o olhar para as obras de três autores expoentes da Teoria Crítica: Walter Benjamin, Theodor W. Adorno e Herbert Marcuse, destacando as reflexões e análises desses autores e utilizando-as como subsídio no campo educativo. A educação autorreflexiva e autocrítica é pensada em seu potencial para a superação das condições (...) de dominação que permanecem em nossa sociedade, cada vez mais tecnificada e pretensamente democrática. This paper outlines an account of political realism as a form of ideology critique. Our focus is a defence of the normative edge of this critical-theoretic project against the common charge that there is a problematic trade-off between a theory’s groundedness in facts about the political status quo and its ability to consistently envisage radical departures from the status quo. To overcome that problem we combine insights from three distant corners of the philosophical landscape: theories of legitimacy by Bernard Williams (...) and other realists, Frankfurt School-inspired Critical Theory, and recent analytic epistemological and metaphysical theories of cognitive bias, ideology, and social construction. The upshot is a novel account of realism as empirically-informed diagnosis- critique of social and political phenomena. This view rejects a sharp divide between descriptive and normative theory, and so is an alternative to the anti- empiricism of some approaches to Critical Theory as well as to the complacency towards existing power structures found within liberal realism, let alone mainstream normative political philosophy, liberal or otherwise. El autor se adentra a fondo en la reciente polémica que le plantea Paolo Rossi, y trae a la palestra los principales elementos que vienen motivándola desde hace más de una década, reflejada en importantes publicaciones. En este artículo el autor disecciona, analiza y replica todas las objeciones realizadas; actividad que, aunque centrada en torno a Vico, sobrepasa este ámbito hacia una dimensión más profunda, que atañe a la histona de la filosofía, al menos en un amplio e importante (...) arco temporal de ésta. Mucho más que una réplica, esta respuesta del autor constituye un evidente ensayo sobre el ejercicio de hacer historia de la filosofía y sobre la consecuente asunción de una línea de trabajo y de una definida concepción del filosofar. Está, además, la consideración ¿nada secundaria¿ de que, como dice el autor, esta "polémica devuelve la voz a una discusión entre historiadores de la filosofía en una situación cultural dentro de la cual el pensamlento de Vico ha llegado a ser, justamente, campo de inteligentes e informados estudios, además de filósofos, de italianistas y de estudiosos de retórica". To what extent are questions of sovereign debt a matter for political rather than scientific or moral adjudication? We answer that question by defending three claims. We argue that (i) moral and technocratic takes on sovereign debt tend to be ideological in a pejorative sense of the term, and that therefore (ii) sovereign debt should be politicised all the way down. We then show that this sort of politicisation need not boil down to the crude Realpolitik of debtor-creditor power relations—a (...) conclusion that would leave no room for normative theory, among other problems. Rather, we argue that (iii) in a democratic context, a realist approach to politics centred on what Bernard Williams calls ‘The Basic Legitimation Demand’ affords a deliberative approach to the normative evaluation of public debt policy options. Objective: to develop and test the factorial structure of a new self-determination theory-based measure of behavioral regulation in children. Method: 590 (F = 51.7%) children aged 7-11 years completed the Motivation to Exercise and Diet (MED-C) questionnaire, which comprises 16 items (8 for exercise and 8 for diet) grouped into eight-factors (5 motivations and 3 needs). Psychometric testing included confirmatory factor analysis and internal consistency. Measurement invariance analyses were also performed to evaluate whether the factorial structure of the MED-C was (...) equivalent for gender (male vs. female), age ( 10yo) and the perception of having at least one parent with overweight or obesity (yes vs. no). Results: factorial analysis confirmed an acceptable factors solution for the MED-C and a good fit to the data for both the exercise and the diet subscales assessed independently. The Maximal Reliability coefficient revealed good reliability for the exercise and the diet subscales. Moreover, the MED-C factor structure was invariant across group comparisons. Discussion: findings support the construct validity and reliability of the MED-C. Therefore, it represents the first validated instrument simultaneously measuring motivational regulation and psychological need satisfaction in the context of children’s exercise and diet. Considering the goodness of these results, scale percentile ranks of the total score distribution as well as the z-score and the T-score were provided for clinical and research purposes. Conclusion: The MED-C might support the understanding of motivations and needs of children with weight problems and assist their process of behavioural change in primary and secondary prevention programs. Psychological factors represent, in fact, potential targets for interventions to increase children’s motivation to exercise and diet. (shrink)

Modern contraceptives—especially long-acting, reversible contraceptives, or LARCs—are typically seen as a boon for humanity and for women, the majority of their users, in particular. But the disparity between the number and types of female and male LARCs is problematic for at least two reasons: first, because it forces women to assume most of the financial and health-related responsibilities of contraception, and second, because men’s reproductive autonomy is diminished by it. In order to understand how to change our current contraceptive arrangement, (...) An individual’s right to refuse life-sustaining treatment is a fundamental expression of patient autonomy; however, supporting this right poses ethical dilemmas for healthcare providers when the patient has attempted suicide. Emergency physicians encounter patients who have attempted suicide and are likely among the first medical providers to face the dilemma of honoring the patient’s DNR or intervening to reverse the effects of potentially fatal actions. We illustrate this issue by introducing a case example in which the DNR of a terminally (...) ill woman was not honored because the cause of her cardiac arrest was suicide. We argue that although a terminal diagnosis should change the way health care providers respond to a suicide attempt, many of the theoretical underpinnings for how one should treat suicide attempts—especially the criterion of external reasonability, that is the action to withhold or withdraw life-sustaining measures is reasonable independent of the precipitating event—are common to all situations :3–12, 2013). The presumption that patients who attempt suicide lack capacity due to acute mental illness is flawed because it fails to account for a competent individual’s reasonable preference to not be forced to live in an unbearable, terminal condition. In states without legislation allowing physician aid in dying, patients and providers must grapple with these limitations on a case-by-case basis. In cases where the patient has a limited life expectancy and there is not concern for psychiatric illness as the primary cause of the suicidal action, we argue that the negative right to refuse life-sustaining treatment should prevail. Classical models of decision making deal fairly well with uncertainty, where settings are well-structured in terms of goals, alternatives, and consequences. Conversely, the typical ill-structured nature of strategy choices remains a challenge for extant models. Such cases can hardly build on the past, and their novelty makes the prediction of consequences a very difficult and poorly robust task. The weakness of the classical expected utility model in representing such problems has not been adequately solved by recent extensions. In this paper (...) we offer an explanatory coherence model for decision making in ill-structured problems. We model alternatives as sets of concurrent causal explanations of reality that act as justifications for action. According to these premises, choice is based on an evaluation of the internal coherence and the consistency of competing explanations of the available evidence. This model is psychologically grounded on causal inference and builds on the connectionist tradition of explanatory coherence. To illustrate the model, we consider the decision of investing in a new technology and we discuss how changes in the structure of alternatives may impact on the solution. We show how the final choice depends on collecting the relevant evidence, making the suitable hypotheses, and drawing the consistent causal explanations linking the two. (shrink)

A necessary component to reproductive autonomy is being trusted to make reproductive decisions. In the case of contraception, however, women are considered both trustworthy and untrustworthy. Women are held responsible for contraception and because responsibility usually stems from trust, it appears that women are trusted with contraception. Yet myriad laws and forms of surveillance and normalization surrounding contraception make women seem untrustworthy. Relying on Amy Mullin’s conception of trust that we trust those who we assume believe in the same social (...) norms we do, I argue that this tension results from two competing social norms. One norm governing contraception is that people should be self-sacrificing, a norm with which most women align due to traditional gender roles. However, there is a norm that women are irrational in general as well as in contraceptive matters and consequently should not be trusted to use contraception. In order to combat both these norms, I make concrete recommendations for increasing knowledge of contraception, normalizing its use, and trusting both women and men with it. (shrink)

This paper develops the idea that valid arguments are equivalent to true conditionals by combining Kripke’s theory of truth with the evidential account of conditionals offered by Crupi and Iacona. As will be shown, in a first-order language that contains a naïve truth predicate and a suitable conditional, one can define a validity predicate in accordance with the thesis that the inference from a conjunction of premises to a conclusion is valid when the corresponding conditional is true. The validity predicate (...) so defined significantly increases our expressive resources and provides a coherent formal treatment of paradoxical arguments. (shrink)

A dominant cultural narrative within Costa Rica describes Costa Ricans not only as different from their Central American neighbours, but it also exalts them as better: specifically, as more white, peaceful, egalitarian and democratic. This notion of Costa Rican exceptionalism played a key role in the creation of their health care system, which is based on the four core principles of equity, universality, solidarity and obligation. While the political justification and design of the current health care system does, in part, (...) realize this ideal, we argue that the narrative of Costa Rican exceptionalism prevents the full actualization of these principles by marginalizing and excluding disadvantaged groups, especially indigenous and black citizens and the substantial Nicaraguan minority. We offer three suggestions to mitigate the self-undermining effects of the dominant national narrative: 1) encouragement and development of counternarratives; 2) support of an emerging field of Costa Rican bioethics; and 3) decoupling health and national successes. The mnemonic arts and the idea of a universal language that would capture the essence of all things were originally associated with cryptology, mysticism, and other occult practices. And it is commonly held that these enigmatic efforts were abandoned with the development of formal logic in the seventeenth century and the beginning of the modern era. In his distinguished book, Logic and the Art of Memory Italian philosopher and historian Paolo Rossi argues that this view is belied by an (...) examination of the history of the idea of a universal language. Based on comprehensive analyses of original texts, Rossi traces the development of this idea from late medieval thinkers such as Ramon Lull through Bruno, Bacon, Descartes, and finally Leibniz in the seventeenth century. The search for a symbolic mode of communication that would be intelligible to everyone was not a mere vestige of magical thinking and occult sciences, but a fundamental component of Renaissance and Enlightenment thought. Seen from this perspective, modern science and combinatorial logic represent not a break from the past but rather its full maturity. Available for the first time in English, this book (originally titled Clavis Universalis ) remains one of the most important contributions to the history of ideas ever written. In addition to his eagerly anticipated translation, Steven Clucas offers a substantial introduction that places this book in the context of other recent works on this fascinating subject. Contraception works by preventing fertilization of an egg or preventing implantation of a fertilized embryo. For those who believe pregnancy begins at implantation, contraceptives preventing implantation are not abortifacient. However, for those who assert that pregnancy begins at fertilization, any agent causing the intentional loss of an embryo, even prior to implantation, is abortifacient, both morally and for lack of a different term to describe the postfertilization, preimplantation loss. In the debate on this topic, much of the discourse on both (...) sides wrongly focuses on the opposing side's perceived ignorance in denying scientifically proven definitions rather than on the substance of the conflict. Indeed, both sides accuse the other of prioritizing its “subjective” views over “objective” facts. In this essay, we unpack the scientific, cultural, and religious factors that underlie this debate. We argue that the only way to move forward is to clarify our terminology and engage with the substance of the argument, rather than merely the rhetoric. (shrink)

In this paper we put forward a realist account of the problem of the accommodation of conflicting claims over sacred places. Our argument takes its cue from the empirical finding that modern, Western-style states necessarily mould religion into shapes that are compatible with state rule. So, at least in the context of modern states there is no pre-political morality of religious freedom that states ought to follow when adjudicating claims over sacred spaces. In which case most liberal normative theory on (...) religious accommodation turns out to be wrong headed. As an alternative, we suggest the question of contested sacred places should be settled with reference to the state’s purposes—at least as long as one is committed to the existence of modern states. If one finds the state’s treatment of religion unsatisfactory, then our argument provides a pro tanto reason for seeking alternative forms of political organisation. (shrink)

Melanie was 29-years-old, married, and hoping to start a family when she discovered a lump in her pelvis. She was diagnosed with non-Hodgkin lymphoma. But one of her biggest fears upon learning of her diagnosis was the possibility of loosing her ability to have children. When Melanie asked her oncologist and radiation oncologist about the risk cancer treatment posed to her fertility, they told her it was small, as only one ovary would be destroyed during the radiation. Deciding to ask (...) for another opinion, she sought out a reproductive endocrinologist, who told her, contrary to what her oncologists had said, that women like her typically did have problems conceiving after radiation treatment on their pelvis. One of the hardest parts of dealing with her dual diagnosis, Melanie later recalled, was the unknown: “I didn't know if my treatment would definitely render me infertile.”. (shrink)

In the United States, single individuals and LGBTQ couples who wish to conceive biological children are considered to be “socially infertile” due to their relationship status. Due to the high cost of infertility treatments and inadequate insurance coverage, the socially infertile has minimal access to assisted reproductive technology. Under the current medical definitions of infertility, even in states with infertility insurance mandates, only heterosexual couples with physiological infertility are covered for ART. It is well documented that infertility interferes with many (...) aspects of the human experience and reduces the quality of life for involuntarily childless individuals regardless of whether the infertility is physiologically or socially based. Physiological infertility was initially considered to be a private issue before being recognized as a medical diagnosis and has since legitimized heterosexual couples’ access to ARTs. The medical diagnosis of infertility not only affirms that their intention to conceive biological children is justifiable but also confirms that it is a condition that can and should be treated with current medical interventions. Expanding the current definition of infertility to include social infertility will elevate it to a treatable medical condition, justifying the use of ART for such individuals and potentially alleviating the negative impacts of infertility. Thus, states with infertility insurance mandates should provide the same infertility coverage to socially infertile individuals as physiologically infertile heterosexual couples. (shrink)

In this paper, we recommend expanding infertility insurance mandates to people who may become infertile because of cancer treatments. Such an expansion would ensure cancer patients can receive fertility preservation technology (FPT) prior to commencing treatment. We base our proposal for extending coverage to cancer patients on the infertility mandate in Massachusetts because it is one of the most inclusive. While we use Massachusetts as a model, our arguments and analysis of possible routes to coverage can be applied to all (...) states' seeking inclusive coverage for infertility treatment. Furthermore, our proposal can also be applied to people with other diseases who may be rendered infertile by treatment. (shrink)

The 'ethical commonwealth', the central social element in Kant's account of religion, provides the church, as 'the moral people of God', with a role in establishing a cosmopolitan order of peace. This role functions within an interpretive realignment of Kant's critical project that articulates its central concern as anthropological: critically disciplined reason enables humanity to enact peacemaking as its moral vocation in history. Within this context, politics and religion are not peripheral elements in the critical project. They are, instead, complementary (...) social modalities in which humanity enacts its moral vocation to bring lasting peace among all peoples. (shrink)

As it has historically been the case with many pandemics, the Covid-19 experience will induce many philosophers to reconsider the value of medical practice. This should be a good opportunity to critically scrutinize the way medical research and medical interventions are carried out. For much of its history, medicine has been very inefficient. But, even in its contemporary forms, a review of common protocols in medical research and medical interventions reveal many shortcomings, especially related to methodological flaws, and more importantly, (...) conflicts of interests due to profit incentives. In the face of these problems, we propose a program of “gentle medicine”. This term, originally formulated by philosopher Jacob Stegenga, describes a form of medicine in which physicians intervene less than they currently do. As part of this general program, we advance a series of reform recommendations that could be enacted both by medical staff in their everyday practice, but also by public health officials and policymakers. This paper provides an interpretation of the licensing provisions envisaged under the Human Fertilisation and Embryology Act 1990 as a model for a rule and exemption-based procedural strategy for the adjudication of potential ethical controversies, and it offers an account of the liberal-democratic legitimacy of the procedure’s outcomes as well as of the legal procedure itself. Drawing on a novel articulation of the distinction between exceptions and exemptions, the paper argues that such a rule and exemption mechanism, while not devoid (...) of attractions, is not immune from the criticisms often levied against procedural approaches to the management of pluralism: it either has to fall back on substantive justification in ways that are not helpful when trying to arbitrate a moral controversy, or it appears justificatorily groundless. No obstante, el presente escrito intentará reconstruir qué entendía el filósofo y pensador nortesantandereano José Rafael Faría Bermúdez sobre esta labor a lo largo de los procesos fundacionales que lideró; es decir, desde la creación del Colegio del Norte hasta la creación de la Universidad de Pamplona. Para esto retomaremos tres puntos que construyen su idea sobre educar. (...) Primero, se tomará la pregunta ¿qué es educar para la vida?; segundo, se analizará la perspectiva con que Faría entendía el papel del estudiante que pregunta con aplomo; y, tercero, se espera responder por qué debemos estudiar con amor. Según Rossi, ambas características corresponderían a un aspecto causal y a un aspecto no causal del azar. Por último, (...) la autora también trata de mostrar la conexión estructural entre los aspectos antes mencionados, tomando como hecho clave la tesis de la coincidencia entre las causas formal, final y eficiente. This paper analyses the details that characterized the negotiation and collection of the servicio de los naturales from the year 1603 onwards, the last time of those three in which moriscos of Granada paid to the Hispanic Monarchy after the Alpujarras War, when they were settled in Castile. The author has analysed documents coming from the Archivo General de Simancas, but also those included in notary’s protocols and in local archives. Its main contributions are three: to publish the content of (...) the actual contract signed by the moriscos and the Crown; to contribute to set up a precise spatial distribution of the communities that paid the tax and, finally, to show the amounts delivered by them. Irregularities, problems, and conflicts lived while the precedent servicios were being paid, are analysed too. There are aspects that we know thanks to other previous works. Nevertheless, if they are considered in relation with the situation of the year 1603, they allow observing that all those difficulties were used in order to improve the servicio itself and the agreement between the minority and the King.
